Agona Swedru High Court has ordered the Akyempim Rural Bank at Dawurampong and three members of staff (one deceased) to pay GH¢4,000 to Mr Simpa Osei Kwabiah in respect of a suit he filed against the defendants.
Mr Justice B.O. Tetteh, a High Court Judge who gave the order, said unless the cost, which was imposed on the defendants about two months ago, the court would not entertain any other action against the Plaintiff.
Mr Kwabiah, the Managing Director of Sokae Enterprises at Agona Swedru, took an overdraft facility of GH¢8,500 from the defendants in December 2004. He was made to use documents on his farm and Valuation Report as collateral and was also made to pay GH¢240 a month to service the loan.
Mr Kwabiah said on March 31, 2006, the defendants and a police officer went to his store at Agona Swedru at a time he was negotiating with one Mr Nkyi to buy his Space Wagon vehicle.
He said upon pressure piled on him by the defendants to pay the loan, he left the store with Mr Nkyi to arrange for a loan.
Mr Kwabiah said at the time they were leaving the store, he had GH¢650 stuffed in a polythene bag which he intended using to pay for the vehicle.
He said he returned to the store at about 1900 hours and found that the GH¢650 in the polythene bag was missing as well as trinkets worth GH¢782 which he kept in a safe in the store.
The Defendants have appealed against the judgement.
