Member of Parliament for Akuapim North, Sammi Awuku, has criticised the National Democratic Congress (NDC) over the non-availability of its Kpandai parliamentary candidate, Daniel Nsala Wakpal, for court service following a Supreme Court ruling on Tuesday, December 16, 2025.
His comments come after Supreme Court decision to halt preparations for the controversial Kpandai parliamentary rerun and the granting of permission for substituted service to be effected on the NDC candidate.
Speaking to Channel One News’ Hanson Agyemang after the ruling, Sammi Awuku expressed surprise at what he described as Nsala Wakpal’s deliberate attempt to evade court service.
“I find it strange that the NDC, who took this case to court, have not made themselves available to be served. You brought the matter to court, you believe you have a good case, why are you running away from service? I am happy the court also granted orders allowing the person to be served through WhatsApp and other means,” he said.
At the hearing, counsel for the applicant, Gary Nimako Marfo, informed the court that Nsala Wakpal had not been served with the judicial review application and requested substituted service.
After detailed deliberations, the five-member panel, presided over by Justice Pwamang, with Justices Kulendi, Tanko, Samuel Asiedu, and Henry Kwofie, granted the request. The court ordered that service be effected through:
- Posting the court processes at Wakpal’s residence in Kpandai,
- Posting on the notice boards of the High Court in Tamale and the District Court in Kpandai
- Sending the processes via WhatsApp to a verified phone number belonging to him.
The court directed that the postings remain for seven days, after which service would be deemed effective.
Meanwhile, the Supreme Court also ordered the Electoral Commission (EC) to suspend all arrangements for the Kpandai parliamentary rerun, pending the final determination of a judicial review challenging the High Court’s annulment of the 2024 election results.
The High Court had annulled the election of NPP candidate Matthew Nyindam on November 24, 2025, following a petition by the NDC candidate. The EC had subsequently announced plans to conduct a rerun, which are now on hold following the Supreme Court’s intervention.
The Supreme Court noted that Nyindam had established a prima facie case in his bid to quash the High Court judgment.
